Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer may exercise the right of withdrawal;

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance agreement with Holy Athletics;

  • Day: calendar day;

  • Durable data carrier: any means that enables the consumer or Holy Athletics to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;

  • Right of withdrawal: the consumer’s option to withdraw from the distance agreement within the cooling-off period;

  • Model form: the withdrawal form made available by Holy Athletics;

  • Entrepreneur: Holy Athletics;

  • Distance agreement: an agreement concluded exclusively through means of distance communication;

  • Means of distance communication: any means that can be used to conclude an agreement without the consumer and Holy Athletics being physically present together;

  • Terms and Conditions: these Terms and Conditions of Holy Athletics.

Article 3 – Applicability

  1. These terms and conditions apply to every offer made by Holy Athletics and to every distance agreement concluded between Holy Athletics and the consumer.

  2. Prior to concluding the agreement, these terms and conditions will be made available to the consumer.

  3. If the agreement is concluded electronically, these terms and conditions will be provided in a manner that allows storage on a durable data carrier.

  4. If specific product or service conditions apply in addition to these terms, the consumer may rely on the provision most favourable to them.

  5. If any provision is void or annulled, the remaining provisions shall remain in full force.

  6. Situations not covered by these terms shall be assessed in the spirit of these terms.

Article 4 – The Offer

  1. Offers with limited validity or conditions will be clearly stated.

  2. All offers are non-binding and subject to change.

  3. Product descriptions are accurate and complete to the best of our ability.

  4. Images are representative; colours may differ slightly.

  5. Obvious errors do not bind Holy Athletics.

  6. Each offer clearly states prices, shipping costs, payment methods, delivery, and withdrawal rights.

Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer.

  2. Electronic acceptance is confirmed by Holy Athletics without delay.

  3. Holy Athletics takes appropriate security measures for electronic transactions.

  4. Orders may be refused or subject to additional conditions.

  5. Agreements are subject to product availability.

Article 6 – Right of Withdrawal

  1. The consumer has the right to withdraw from the agreement within 14 days after receiving the product.

  2. Products must be handled with care during the cooling-off period.

  3. Products must be returned within 30 days after notification.

  4. Failure to comply makes the purchase final.

Article 7 – Costs in Case of Withdrawal

  1. Return shipping costs are borne by the consumer.

  2. Refunds are made within 30 days after receipt or proof of return.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for:

– Custom-made or personalised products;
– Hygienic products with broken seals;
– Products that are no longer in new condition due to use.


Article 9 – Prices

  1. All prices include VAT.

  2. Prices may change due to VAT adjustments.

  3. Obvious pricing errors do not entitle delivery at incorrect prices.

  4. Discount codes must be entered at checkout to be applied to an order. Discount codes cannot be applied retroactively to completed orders. If a discount code is not used at the time of purchase, no refunds or partial refunds will be issued to account for the missed discount.

Article 10 – Conformity and Warranty

  1. Products comply with the agreement and legal requirements.

  2. Warranties do not affect statutory rights.

  3. Defects must be reported within 14 days of delivery.

  4. Warranty is void in case of improper use.

Article 11 – Delivery and Execution

  1. Delivery is made to the address provided by the consumer.

  2. Orders are delivered within 30 days, unless agreed otherwise.

  3. In case of delay, the consumer may dissolve the agreement free of charge.

  4. Risk transfers upon delivery.

Article 12 – Payment

  1. Payments must be made within 7 working days, unless agreed otherwise.

  2. Incorrect payment details must be reported immediately.

  3. Reasonable collection costs may be charged in case of non-payment.

Article 13 – Complaints Procedure

  1. Complaints must be submitted within 7 days after discovery.

  2. Complaints are answered within 14 days.

  3. Unresolved complaints constitute a dispute.

Article 14 – Disputes

  1. Dutch law applies exclusively.

  2. The Vienna Convention on Contracts for the International Sale of Goods does not apply.

  3. Holy Athletics is not liable for injury or physical complaints arising from product use.

Article 15 – Additional or Deviating Provisions

Additional provisions may not disadvantage the consumer and must be recorded in writing.
